PP-DB ask the Constitutional Court if the current Supreme Judicial Council can elect prosecutor general

“We Continue the Change – Democratic Bulgaria” have filed a request with the Constitutional Court for the interpretation of a text from the basic law, according to which the composition of the Supreme Judicial Council can elect a prosecutor general and a president of the Supreme Administrative Court.

“The Supreme Judicial Council with an expired mandate, completely de-legitimized before the society, cannot invest trust in such an important election for the judicial system – especially since there are five missing members in the professional quota elected by the magistrates themselves,” MP and former Minister of Justice Atanas Slavov said. The coalition will propose legislative changes that would stop the current procedures for electing a prosecutor general and president of the Supreme Administrative Court.

MP Vasil Pandov said the Constitutional Court should consider the practices of the Court of Human Rights, according to which bodies of the judiciary with an expired mandate should not elect leading bodies of the judicial systems.
