Supreme Court of Cassation removes Borislav Sarafov as acting chief prosecutor

The Criminal Division of the Supreme Court of Cassation (SCC) ruled that the acting chief prosecutor's powers automatically terminate after the six-month period allowed by legislation. Consequently, Borislav Sarafov is no longer acting chief prosecutor, and any requests he made in criminal cases filed with the Supreme Court after 21 July are invalid.

The SCC's announcement confirmed the view of many legal experts that Sarafov could not remain in the position. Sarafov assumed the functions of chief prosecutor on 16 June 2023. Earlier this year, the Prosecutor’s College of the Supreme Judicial Council had decided that the new law, which came into force on January 21, 2025, would apply to the next acting chief prosecutor, but not retroactively to the current situation.
